These terms and conditions are intended to contain all the terms of the agreement between us (the Vendor) and you (the Purchaser) relating to the sale and purchase of the Vehicle and/or Product(s). The Purchase Price is the price for the vehicle. In addition, the invoice may be listed with additional items such as a Warranty, Delivery etc. An ‘Inspect and Protect’ premium is applied to all purchases.*
If we have agreed to accept a Part Exchange Vehicle at an agreed value in part payment of the Purchase Price, we shall only be bound to do so if the Part Exchange Vehicle is: -
If you fail to satisfy any of the above conditions, we will not be obliged to accept the Part Exchange Vehicle or to allow the Part Exchange Valuation against the Purchase Price and you may be required to pay the full Purchase Price before you take collection of the vehicle and/or products. We reserve the right to offer you an amended price for the part exchange should issues be identified affecting the original valuation.
We aim to arrange the handover of the vehicle at our place of business to you as soon as possible. On request we can arrange delivery to an address of your choice at an additional cost.
Deposits are non-refundable. When a deposit is placed on a vehicle and you choose to cancel the agreement, the deposit paid to Big Van World associated with the transaction will be forfeited.
The Vehicle and/or Products will continue to belong to us until the total Purchase Price has been paid and cleared in full. You will, however, be responsible for any loss or damage from when you take delivery and should insure accordingly.
The following means of payment are acceptable:
(a) BVW shall use all reasonable endeavours to pass the benefit of any manufacturer’s warranty on to the Customer. Any parts which require replacement during the period of the manufacturer's warranty as a result of wear and tear (for example but without limitation, the brake pads) are excluded from the warranty. The manufacturer's warranty is not affected by any change of ownership of the Goods. Remedial work under such warranty may be carried out by any dealer approved by the relevant manufacturer (“a Dealer”) at whose sole option any defective parts will be repaired or replaced. Any part replaced under the manufacturer's warranty is warranted to be free from defects in parts and materials until expiry of the original vehicle warranty. The manufacturer's warranty does not apply if and to the extent that the defect is caused or worsened by one of the following circumstances:
(i) after discovering the defect the Customer has failed either to inform BVW or to have the defect examined by a Dealer without reasonable delay;
(ii) has failed to give a Dealer the option to repair the Goods without reasonable delay;
(iii) the Goods or any part thereof have been subject to misuse, negligence, or accident or use for racing or similar sports;
(iv) if the Goods have been repaired or maintained and that repair or maintenance has not been carried out by or through a Dealer and/or to the manufacturer’s recommendations;
(v) parts have been installed into the Goods the use of which have not been approved by the manufacturer or if the Goods have been altered or modified in a manner not approved by the manufacturer;
(vi) instructions concerning the treatment, maintenance and care of the Goods have not been adhered to.
(b) In the case of the Goods being a second-hand vehicle, BVW shall transfer to the Customer the unexpired portion of the manufacturer’s warranty (if any) together with any used car warranty made available with respect to the Goods as stated on the front of the order.
(c) If the Manufacturer’s warranty has expired on your retail sale, BVW provides You with a 6-month warranty for the Vehicle free of charge through our third- party warranty partner, Momentum Warranties. Your 6-month warranty includes unlimited claims up to the value of the vehicle and Momentum Warranties offer Momentum Approved Repairs centres all over the UK. You will automatically be opted in for this 6-month warranty at the time of purchase, but You can cancel this benefit on our Site before You place Your Order. If You remain opted-in for this benefit, Your direct contractual relationship will be with our third-party warranty provider on these terms.
(d) You can choose to buy an extended warranty for up to 3 years with increased coverage and claim limit, one of our sales executives will give you this option at the time of the order being taken. To facilitate any extended warranty you might purchase, our third-party warranty provider (Momentum Warranties) will issue you with this, you can buy an extended warranty by contacting Big Van World by telephone on 01793 751866 or contacting your sales executive directly, In each case, if you buy an extended warranty, your direct contractual relationship will be with our third-party warranty provider on these terms. (e) Unfortunately we are not able to provide any additional warranty guarantee on Heavy Goods Vehicles(HGV).
(f) Any vehicles that are sold for spares or repairs or within the motor trade are not covered by any warranty given or implied.
